No Guarantee of Sale or Purchase
Kanish Realty does not guarantee that any property will be sold or purchased through our services. The success of any real estate transaction depends on various factors beyond our control. -
No Price Guarantee
We do not provide any guarantee regarding property prices. Market conditions and other factors may affect property values, and final prices are subject to negotiation between buyers and sellers. -
Independent Agents
All real estate agents associated with Kanish Realty are independent contractors. Kanish Realty is not responsible for the actions, representations, or conduct of these independent agents. -
Limited Liability
Kanish Realty assumes no responsibility or liability for any aspect of the real estate transaction. Our role is limited to facilitating connections between buyers and sellers. -
Legal Proceedings and Waiver of Rights
Users of our services agree not to initiate legal proceedings against Kanish Realty related to any real estate transaction. By agreeing to these terms and conditions, you expressly waive and forgo any and all rights to take legal action against Kanish Realty, its employees, agents, or affiliates in any court of law or equity. Any disputes should be resolved directly between the buyer and seller or through the arbitration process outlined in these terms. This waiver includes, but is not limited to, the right to file a lawsuit, seek injunctive relief, or pursue any other form of legal remedy against Kanish Realty. -
Transaction Finalization
The finalization of any real estate transaction is solely between the buyer and seller. Kanish Realty has no obligation or involvement in the closing process or final agreement between parties. -
Vetting Responsibility
The responsibility for vetting potential buyers or sellers rests entirely with the customer. Kanish Realty does not conduct background checks or verify the credentials of users on our platform. -
Use of Information
While we strive to provide accurate information, Kanish Realty does not guarantee the completeness, accuracy, or reliability of any information provided. Users should independently verify all information before making any decisions. -
Termination of Service
Kanish Realty reserves the right to terminate or suspend access to our services at our sole discretion, without prior notice or liability. -
Governing Law
These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction where Kanish Realty is headquartered. -
Arbitration
Any dispute or claim arising out of or relating to the use of Kanish Realty’s services shall be settled by binding arbitration, rather than in court. The arbitration shall be conducted by a single arbitrator agreed upon by both parties or appointed by the Superior Court. The arbitrator shall be a retired judge or a licensed attorney with at least five years of real estate experience. -
Arbitration Location
The location for any arbitration proceedings shall be determined by Kanish Realty. By agreeing to these terms and conditions, you consent to the arbitration location chosen by Kanish Realty. This could be of any location around the world. -
Binding Decision
The decision of the arbitrator shall be final and binding on all parties involved. By agreeing to arbitration, you waive your right to a trial by jury or judge. -
Time Limit
Any request for arbitration must be filed within 180 calendar days after the closing of the transaction or within 180 calendar days after the facts constituting the arbitrable matter could have been known in the exercise of reasonable diligence, whichever is later. -
Costs
Each party shall bear its own costs, including attorney’s fees, associated with the arbitration process.
