By purchasing a package, you acknowledge that you have read, understood, and agree to be bound by these terms. There are other links in website for packages, including packages with offers and hidden packages for which all these conditions apply. 

1. Package Details

Kanish Realty offers various subscription packages for listing real estate properties on our website. These packages are available to both property owners and real estate agents. Details of current packages, including features and pricing, can be found at https://kanishrealty.com/packages/.

Important Note: Package details, features, and pricing are subject to change at any time without prior notice. It is your responsibility to review the package details before making a purchase.

2. No Commission Split

Kanish Realty does not take any commission split from any real estate transaction. We provide a platform for listing properties, and all negotiations and transactions are solely between the property lister (owner or agent) and the potential buyer/renter.

3. Package Purchases are Final and Non-Cancellable

All package purchases are final. Once payment is made, the package is non-cancellable.

4. No Refunds

Due to the nature of the service, we do not offer refunds for any purchased packages. You acknowledge and agree that you are purchasing the package at your own risk. Please carefully consider your needs before making a purchase.

5. Self-Service Platform & No Customer Support

Kanish Realty is a self-service platform. We do not provide dedicated customer support for package usage. You are responsible for managing your listings and utilizing the features of your chosen package.

6. Independent Agents

Real estate agents using Kanish Realty are independent contractors and are not employees or agents of Kanish Realty. Kanish Realty is not responsible for the actions or omissions of any agent.

7. Agent Profiles and Package Renewals

Real estate agents can create a profile on Kanish Realty. Creating and maintaining a profile requires an active package. If an agent’s package is not renewed, their profile and all associated property listings will be automatically disabled.

8. Modification of Terms

Kanish Realty reserves the right to modify these Terms and Conditions at any time without prior notice. Any changes will be effective immediately upon posting on the website. Your continued use of the website and purchase of packages after any such changes constitutes your acceptance of the new Terms and Conditions.

9. Risk Assumption

You acknowledge that you are using the Kanish Realty platform and purchasing packages at your own risk. Kanish Realty is not responsible for any losses or damages incurred as a result of using our services. This includes, but is not limited to, financial losses, loss of leads, or any other consequential damages.

10. Arbitration and Governing Law

Any dispute arising from or relating to these Terms and Conditions shall be resolved exclusively through arbitration. The arbitration will take place at a location chosen by Kanish Realty, which may be in any country or city, regardless of where the customer is located. The customer may suggest a preferred location for the arbitration at the time of initiating the process, but the final decision on the arbitration venue rests solely with Kanish Realty.

The arbitration shall be conducted in accordance with the rules of the arbitration institution selected by Kanish Realty. The language of the arbitration shall be English unless otherwise agreed upon by both parties.

This arbitration clause shall be governed by and construed in accordance with the laws of the jurisdiction where the arbitration takes place, as determined by Kanish Realty.

By agreeing to these Terms and Conditions, you waive any right to participate in a class action lawsuit or class-wide arbitration.

11. Trademark Usage

Kanish Realty is a registered trademark. To use the name “Kanish Realty,” you must be registered on the website as an agent. Unauthorized use of the Kanish Realty trademark is strictly prohibited and may result in legal action.

12. Agent Registration

Real estate agents wishing to use the Kanish Realty platform and its services must complete the registration process on the website. Only registered agents are authorized to use the Kanish Realty name in connection with their real estate activities on the platform7.

13. Trademark Protection

Kanish Realty reserves the right to protect its trademark against unauthorized use. This includes, but is not limited to, use in domain names, usernames, email addresses, or any other online or offline identifiers

14. Compliance with Trademark Laws

All users of the Kanish Realty platform are required to comply with applicable trademark laws and regulations. Any misuse of the Kanish Realty trademark may result in the termination of your account and potential legal consequences

15. Responsibility to Monitor Terms and Conditions
